These Terms of Service ("Terms") govern your use of SurveyAgent.ai's services ("Services"). By accessing or using the platform, you agree to be bound by these Terms.

1. Use of Services

SurveyAgent.ai provides AI voice agent solutions for businesses. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws and regulations, including HIPAA, GDPR, SOC 2, and ISO standards.

2. Account Registration

To access the platform, users must register for an account, provide accurate information, and maintain the confidentiality of their login credentials. You are responsible for all activities that occur under your account.

3. Data Privacy and Security

We are committed to maintaining the privacy, confidentiality, and integrity of your data. SurveyAgent.ai complies with:

  • HIPAA for health data privacy and security
  • GDPR for data protection and rights of EU users
  • SOC 2 Type II for operational and system controls
  • ISO/IEC 27001 for information security management.

4. Data Ownership and Use

You retain ownership of your data. SurveyAgent.ai will only process personal data in accordance with your instructions and solely for the purpose of delivering Services. Data is not sold or shared with third parties without explicit consent.

5. Sub-Processors

We may use vetted sub-processors who meet HIPAA, GDPR, SOC 2, and ISO standards. A list of sub-processors is available upon request.

6. Service Availability

While we aim for 99.9% uptime, we do not guarantee uninterrupted availability. Scheduled maintenance or unforeseen issues may result in temporary downtime. We will notify users in advance where possible.

7. Payment Terms

All paid plans require timely payments based on your subscription. Failure to pay may result in service suspension. All fees are non-refundable unless otherwise stated in a specific agreement.

8. Termination

You may cancel your account at any time. SurveyAgent.ai reserves the right to suspend or terminate access for violations of these Terms, applicable laws, or security standards.

9. Limitation of Liability

SurveyAgent.ai shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for services in the preceding three months.

✅ Data Processing Agreement (DPA)

This Data Processing Agreement ("DPA") forms part of the Terms of Service between you ("Data Controller") and SurveyAgent.ai ("Data Processor").

1. Scope

SurveyAgent.ai will process personal data on behalf of the Controller in compliance with:

  • HIPAA
  • GDPR
  • SOC 2
  • ISO/IEC 27001

2. Nature and Purpose of Processing

Data will be processed to deliver voice agent automation and related services, including call handling, data transcription, analytics, and optimization.

3. Data Subjects and Types

  • Data Subjects: Your customers, employees, contractors
  • Data Types: Names, phone numbers, email addresses, voice recordings, call logs, and custom metadata

4. Responsibilities of the Processor

SurveyAgent.ai will:

  • Process data only under written instructions
  • Implement appropriate technical and organizational measures
  • Maintain records of processing activities
  • Assist with responding to data subject requests
  • Notify you of any data breach within 48 hours.

5. Sub-Processors

SurveyAgent.ai uses sub-processors that meet the same compliance standards. You will be notified of changes and may object within 30 days.

6. Data Transfers

Where data is transferred outside the originating country, appropriate safeguards are applied, including SCCs (Standard Contractual Clauses) or equivalent mechanisms.

7. Retention and Deletion

Data is retained for the duration of the contract. Upon termination, data will be deleted or returned, as per your request, within 30 days.

8. Audits and Inspections

You may audit SurveyAgent.ai’s compliance once annually with reasonable notice and subject to confidentiality.

9. Liability

Each party shall be responsible for its own non-compliance. SurveyAgent.ai’s liability is limited as per the Terms of Service.
